Disability Law Center v. SG BOULEVARD MULTIFAMILY LLC d/b/a CITY VIEW ST. GEORGE; AJC Architecture; Wasatch Commercial Builders; PEG Property Group (Filed on March 1, 2023 in federal district court)

In March 2023, the DLC filed a housing discrimination and public accommodations access case against an apartment complex owner, builder, developer, architect and property management company, alleging that City View Apartments in Saint George, Utah, failed to design and construct its apartment building in compliance with the Fair Housing Act, and alleging that City View Apartments failed to maintain an accessible leasing office in violation of Title III of the ADA.

This litigation is a design and construction case under the Fair Housing Act, and the basis for the complaint was initiated by testers for the DLC. Testers performed an on-site design and construction test at City View Apartments in Saint George, Utah. City View Apartments includes one leasing office, two residential buildings, a parking garage, and various amenities on-site. During the assessment, the testers took measurements and photographs of common areas, a unit they were shown, and the leasing office. Numerous items were identified that suggest noncompliance with the Fair Housing Amendments Act’s design and construction guidelines and Title III of the ADA’s requirement that places of public accommodation should be readily accessible to individuals who use wheelchairs.
